Decree by the Ministry of Health of Ukraine № 188 of 08/01/2000

According to this decree, narcotic drugs include:

Cannabis - whole or various degrees of grinding, any parts of a plant of the hemp genus or mixtures thereof (except for mature seeds< span>) regardless of whether they succumbed to extraction, destruction, rotting or mold damage.

Cannabis resin - a mixture of extracted resin, pollen or plant parts containing THC.

Cannabis extracts (tinctures) products obtained from any type and variety of hemp by extraction and containing THC.

Article 162-2 Illegal planting or cultivation of hemp

Illegal sowing or illegal growing of up to 10 cannabis plants is subject to a fine of 18 to 100 non-taxable minimums income of citizens with confiscation of illegally grown plants.

The criminal legal concept “sowing” means the illegal introduction of cannabis seeds into open or temporary (closed) ground, as well as planting acquired hemp into open ground, i.e. . seedlings of these plants grown by another person.

Ways and means, while the values ​​used do not matter. Sowing can be carried out anywhere: on a personal plot, wasteland, fields of state and collective farms, etc.

The concept of “cultivation” covers various work on the care of crops (sown area) and drug-containing plants, the cultivation of which is punishable by criminal law (processing, combating pests, fertilizing, watering, including caring for seedlings in closed ground).

Article 44 Illicit production, acquisition, transportation, storage, transfer of narcotic drugs or psychotropic substances without the purpose of sale in small quantities

Illegal production, acquisition, transportation, storage, transfer of narcotic drugs or psychotropic substances without the purpose of sale in small quantities entails a fine of from 25 to 50 tax-free minimum incomes of citizens or community service for a period of 20 to 60 hours, or administrative arrest for a period of up to 15 days.

Amounts of narcotic drugs considered small, large and extra large are determined by Decree of the Ministry of Health Ukraine No. 188 of 08/01/2000.

At the same time, a small amount is dry (in terms of dry) vegetable weight up to 5 g. Large sizes from 500 to 2500 g, extra large sizes - 2500 g and more.

Cannabis resin: small sizes up to 0.5 g, large sizes from 50 to 500 g, extra large sizes from 500 g or more.

Cannabis extracts small quantities are considered up to 0.3 g, large quantities from 5 to 100 g, especially large quantities - more than 100 g.

Article 310 Sowing or growing sleepy poppy or hemp

Part 1 Illegal sowing or cultivation of cannabis will result in a fine of up to 50 tax-free minima< span> income of citizens or arrest for up to 6 months, or restriction of freedom for up to 3 years.. span>

Part 2 Illegal sowing or cultivation of cannabis by a person who has been convicted under this article or who has previously committed one of the crimes under articles 307, 309, 311, 317 , or committed by prior conspiracy by a group of persons for the purpose of sale, or illegal sowing or cultivation of hemp in the amount of more than 50 plants. Punishable by imprisonment for from 3 to 7 years.

Part 1 qualifies the actions of persons who illegally planted or cultivated cannabis in an amount of less than 50 plants. Growing a small number of plants may be grounds for liability under Art. 162-2 CAP of Ukraine.

Article 309 Illicit production, manufacture, purchase, possession, transportation or transfer of narcotic drugs

Part 1 Illegal production, manufacture, acquisition, storage, transportation or transfer of narcotic drugs, psychotropic substances or their analogues without purpose sale - entail a punishment in the form of restriction of liberty for a period of up to 3 years or imprisonment for the same period.

Production means serial production of narcotic substances or psychotropic substances from chemicals or plants. Serial receipt means - receipt of series of a certain standard. Those. typical products that meet certain requirements: chemical composition, weight, shape.

Production is considered to be all actions, including refining and extraction, which result in the production of narcotic substances, their concentration increases, and the transformation of narcotic funds into ready-to-use forms, regardless of the condition of the feedstock and the final product.

Manufacturing of narcotic drugs is also considered simple operations: drying, cutting plants, separating inflorescences.

Acquisition of narcotic drugs or psychotropic substances is their purchase, receipt in exchange for other goods and things, receipt in the form of a loan, gift, award, payment of a debt, appropriation found, collecting wild cannabis. Thus, the acquisition can be both “paid” and “free”.

Storage is any deliberate action related to the illegal possession of narcotic drugs or psychotropic substances by the guilty person. At the same time, it does not matter the duration of storage and whether secretly or openly and in what particular place these funds or substances were stored.

Transportation - the movement of drugs from one territory to another within Ukraine using any vehicle. For the recognition of carriage, the mode of transport does not matter, whether the person is the owner of the vehicle and the distance.

Unlawful sale means: any attempt paid or free distribution to an indefinite number of persons ( sale, donation, exchange, payment of a debt, loan, injection of a drug by its owner to another person - treating cigarettes that contain narcotic substances, etc.).

Article 307 Illicit production, manufacture, purchase, possession, transportation for sale or sale of narcotic drugs< /strong>

Part 1Illegal production, manufacture, acquisition, possession, transportation or shipment for the purpose of sale, as well as illegal sale of narcotic drugs, psychotropic substances and their analogues - shall be punishable by imprisonment for a term of 3 to 8 years.
